<p>Admit it San Diegans, we are just not that good at driving in the rain.  Probably because it rarely rains.  As a result, when we have a rainy season like this year, we see a lot of accidents because of the rain.</p>

<p>After a fairly rainy winter, spring has brought some nice dry days.  <a title="Rain is on its way back to San Diego" href="http://www.sandiego6.com/news/local/story/Rain-Moving-Towards-San-Diego/OgobxJVsNUu6_iCUIQqUxQ.cspx" target="_blank">But according to the weather people the rain is on the way back.</a></p>
<p>Given the number of wrecks in which rain was a significant factor early in the year, we though it would be a good idea to post a few tips for safe driving in the rain so that our readers might avoid getting in a San Diego car accident.</p>
<p><strong>Be especially careful during the first few hours of rain.</strong> Oil and other slippery substances build up on the road.  This buildup mixes with the rain and can cause extremely slick surfaces.</p>
<p><strong>Leave earlier. </strong> It is most likely going to take you longer to get where you are going when it is raining (especially in San Diego where rain is fairly uncommon).</p>
<p><strong>Start using your brakes earlier and brake easier. </strong> It is simple, this reduces your chance of locking up the brakes.</p>
<p><strong>Avoid standing water. </strong> You are morel likely to hydroplane when there is standing water.  If you see a puddle, go around it.  Along, the same lines, try to drive close to the center of the road since most of our roads are built to have water run off the side.</p>
<p><strong>Don&#8217;t use cruise control.</strong> Cruise control wants you to keep you at a speed so when you may need to decelerate due to a loss of traction, cruise control may actually try to speed up, possibly spin the tires and make the situation worse.</p>
<p><strong>Do not cross running water. </strong> Despite repeated warnings when it rains, it seems to never fail that someone tries to cross an overflowing stream. Don&#8217;t do it.  Don&#8217;t become the 10 O&#8217;clock news story of the person that had to abandon their car and be rescued from a stream.</p>
<p><strong>Turn on your headlights and use your blinkers.</strong> Rain reduces visibility.  Simply turning on your headlights will do a lot to help other drivers see you.    Not only that it is the law in California &#8211; <a href="http://www.dot.ca.gov/hq/paffairs/news/pressrel/08pr5.htm" target="_blank">California Headlight Law</a>.  Blinker will help others see what you are planning to do and react accordingly.</p>
<p><strong>Watch out for pedestrians.</strong> Too many pedestrians are hit even when it isn&#8217;t raining.  Add the distraction of the rain to both drivers and pedestrians and it becomes significantly more dangerous.  Keep an eye out.</p>

<p>If you have been in a car accident or suffered personal injury in some other way and you have sued the responsible person, you will likely have to submit to a defense medical exam or DME.  Ok, the real name of it is a Independent Medical Exam or IME.  I refer to it as a DME because it is performed by a doctor paid for by the defense and so in my mind not truly independent. <a title="Independent Medical Exam" href="http://law.justia.com/california/codes/ccp/2032.210-2032.260.html">California Code of Civil Procedure Sections 2032.210-2032.620</a> govern the DME.</p>
<p>The Defense Medical Exam is one of the most important parts of a lawsuit.  The reason it is one of the most important parts of the lawsuit is that the doctor examining you is most likely the doctor that the defense will use at trial to say you are not really hurt, you not hurt as bad as you claim, or that you should have been better in a few days.  Remember, people (juries) tend to believe doctors.  So what the defense medical exam doctor says about you at trial can dramatically effect the outcome of your case.</p>
<p>Ok, so now you understand it is important but what do you do about it?</p>
<ol>
<li>Always remember that ultimately the defense is paying this doctor to find that you are not hurt very bad &#8211; the doctor is not on your side</li>
<li>Do not minimize your injuries (too many people act like a tough guy in these exams and minimize their injuries &#8211; this is time to let the defendant know just how badly you are hurt)</li>
<li>Do not overstate your injuries (remember the person examining you is a doctor and will know when you are exaggerating and will hold   it against you)</li>
<li>Expanding on 2 and 3 &#8211; be very clear about your injuries</li>
<li>Do not involve yourself in a conversation with the doctor that has nothing to do with your injuries as the defense doctors can and will find a way to use this to hurt your credibility</li>
<li>Always remember that ultimately the defense is paying this doctor to find that you are not hurt very bad &#8211; the doctor is not on your side (I know I repeated this but is that important)</li>
</ol>
<p>If you have a Car Accident or Other Personal Injury case in San Diego, California, there is a good chance that you will see one of a handful of doctors.  This really should not be surprising, once these doctors know what the defense attorneys want and give it to them, the doctors will be hired over and over.  The doctors can often make as much money doing these exams and testifying at trial as they can in their normal practice (this brings us back to number 1 and 6 above).  But this is not always a bad thing.  If you have hired an experienced personal injury attorney, he will have information on the doctors that testify regularly that will be helpful at trial.</p>
<p>Another recommendation that I have is that you make sure your attorney send a letter to the doctor ahead of time confirming that the doctor has all of your applicable medical records and any other information he needs for the exam.  The reason for this is that the exam should only be about your current condition and not your medical history or what happened the day of the injury (that is what the deposition is for and the defense has no right to make you go through that again &#8211; especially if they are doing to find inconsistencies to use against you.</p>
<p>Finally, encourage your San Diego personal injury lawyer to send someone from her office to attend the DME with you.  This is important because what you remember happened and said at the Defense Medical Exam and what the doctor says you said are often different.  At trial, it is just your word (someone trying to get money through a lawsuit) against a doctor (a respected member of the community).  Having someone there with you and the doctor will help ensure that the story told by everyone at trial will be what really happened.</p>
<p>This post is the first in a series of what people involved in a lawsuit because of a car accident or other personal injury can expect during the lawsuit.  Check back often for more updates.</p>
<p>I also want to make clear that most doctors out there that do defense medical exams are respectable and honest.  You can expect them to examine you and give a fair assessment.  There are some (like in all professions), however, that will not.  They will almost always say a plaintiff is not hurt very bad and should have recovered in a few weeks.  It is because of those few doctors, that I provide the advice here.</p>

			<content:encoded><![CDATA[<p><a title="San Diego Auto Accident Lawyer" href="http://www.thompsonlawsd.com/lawyer-attorney-1357756.html">San Diego Car Accident Lawyer</a> &#8211; Earlier today, March 2, 2010, a driver died in a San Diego Car Accident.  The collision happened just south of Ocean View Blvd. on State Route 15 around 11:35 a.m.  The car accident occurred when a car struck the rear of a 18 wheeler truck.  The big rig truck was disabled and on the side of the road.  While the exact cause of the accident is unknown at this time, you can see from the picture below that the roads were wet at the time of the picture which makes us wonder if  a wet road played a role in the accident.</p>

<p>You can also see from the picture that the force of the car accident was large as the car initially struck the rear of the semi truck but ended up in front of it.</p>

			<content:encoded><![CDATA[<p><a title="San Diego Pedestrian Injury Lawyers" href="http://www.thompsonlawsd.com/lawyer-attorney-1357779.html">San Diego County Pedestrian Accident Lawyer</a> &#8212; While leaving a romantic gesture with chalk on the road outside of his girlfriend&#8217;s Fallbrook home, a man was struck and killed by a school bus.  The man, Deio Alcala, was kneeling the turn land on Reche Road.  According to the California Highway Patrol, the man looked up but did not move in time and the 25 person bus hit him around 5:45 a.m. on Friday February 26, 2010. The impact knocked him into a Ford Explorer and he died at the scene.  It appears that there were no people on the bus other than the driver, who was unhurt.</p>

<p>While it is unclear at this time if the driver had time to stop, we want to remind everyone to keep a special lookout for pedestrians when driving. They are unprotected and a great risk of injury.</p>

<p>The woman was close to South Kalbaugh Street on the west side when she tried to cross about.  The woman walked in a 2001 Dodge Ram 250.  The truck was going about 40 m.p.h and traveling North.  According to the California Highway Patrol, the woman may have been drinking prior to the accident.</p>
<p>After accident the woman was transported to the hospital awake and alert with an ankle injury.  Unfortunately, she died the next day in the hospital from complications related to brain swelling.</p>
<p>Fortunately, the driver was not hurt.</p>

<p>The SUV ended up on its wheels and the man was wearing a seat belt.  Unfortunately the SUV&#8217;s roof caved in and caused severe head injuries leasing to the mans death.</p>

<p>The sign seems harmless enough right?  In fact, I think it is great we are putting reminders out there that motorcycles are harder to see and we need to pay special attention.  Several San Diego residents apparently disagree. According to <a href="http://www.signonsandiego.com/staff/janet-lavelle/">JANET LAVELLE</a> of the Union Tribune, the reaction to this sign has been very negative with about a dozen callers complaining to San Diego CalTrans including a 20 minute rant.  The negative response was not expected and contrasts heavily with the positive calls received throughout most of the state.  The anger seems to stem from motorcycles sharing lanes.  While not necessary safe, it is a legal practice.</p>
<p>In addition, the statistics regarding motorcycle accident deaths in San Diego county rose 225% from 16 motorcycle accident deaths in 1999 to 52 in 2008.  In comparison, the increase statewide was a much lower 130%.</p>

<p>According to the county Medical Examiner’s Office, the victim was hit by an eastbound vehicle.  Police said the driver was last seen heading east on Market and believe the hit-and-run driver was driving a pick-up or similar vehicle.  The vehicle&#8217;s right side front window is broken and it is missing part of its right front bumper.  The vehicle also might have red paint on it from the from hitting the women&#8217;s car.  The driver is possibly white and in his 50s with white or gray curly hair.</p>
<p>People who work in the area described the stretch of road as dangerous for pedestrians because of heavy traffic and speeding vehicles.  We encourage you to be very careful if you have to drive or get out car in this area and look carefully for oncoming traffic.  Our San Diego Pedestrian Accident Attorneys will be trying to get accident statistics for the area.</p>

			<content:encoded><![CDATA[<p>San Bernardino Car hit bicycle riders and flees scene.  The 19 year old, Thomas Joseph Meeks, was traveling on his bicycle with his younger brother when he was struck and killed by a hit and run driver in San Bernardino.  Meeks and his brother were bicycling on 40th street when he was struck a vehicle traveling the same direction, according to a San Bernardino Police Department statement.   Meeks was pronounced dead at the scene and his younger brother was critically injured and taken to Loma Linda University Medical Center.</p>
<p>According to witnesses of the car hitting bicycle accident, the vehicle that fled the scene was a white 2000 or older Pontiac or Chrysler car.  Authorities said the vehicle should have front-end damage around the license plate area and possibly the windshield. 			<content:encoded><![CDATA[<p>The U.S. Consumer Product Safety Commission and Health Canada recently announced a voluntary recall of the 11,000 Glass Water Bottles in the United States and 1,200 in Canada imported by Starbucks.</p>
<p>The glass water bottle and/or its stopper is a hazard because it can shatter when the consumer removes or inserts the stopper.  This creates a laceration concern for consumers.  Indeed, the recall was prompted by 10 reports of either glass stoppers or water bottles shattering, including eight reports of hand lacerations.</p>
<p>The recalled 20-ounce clear glass water bottles have a SKU number 11003503 and the work “Glass Water Bottle” printed on a blue label affixed to the bottle.</p>
<p>Consumers should stop using these glasses immediately and return them to Starbucks for a full refund and complimentary drink of any size.</p>
